NOTE: Beginning on 1 September 2011 and again on 1 January 2012, several new laws governing HOA/POA in Texas will take effect. The RMRPOA Bylaws and Covenants & Restrictions are in compliance with these new laws. In any case where the current wording of the RMRPOA documents is in conflict with the wording of the new laws, the wording of the Texas laws will govern. Please see the August 2011 Board Minutes for a summary of the areas affected by these new Texas laws. The POA Board is currently working with legal counsel to ensure that we are in full compliance with these laws. Amendments to our Bylaws and Covenants & Restrictions are now in work. One of the most exciting changes is that Texas will allow electronic voting beginning in 2012. The POA Board is currently working with a software vendor to implement electronic voting for the 2012 Board Election.

Updated Proxy Forms

Our newly updated and approved Proxy Forms are now available for the members to download. There are two different forms: a General Proxy and a Proxy for a specific meeting, such as the Annual Meeting in January and the Summer Meeting in June of each year.

The General Proxy Form must be completed, signed by the property owner, and returned by mail or in person to the River Mountain Ranch POA Board Secretary. The General Proxy is valid for 180 days from the date signed (RMRPOA Bylaws, Article 3, Section 3.08).

This form might be used, as an example, by property owners that live a long distance from the Wimberley area but wish to give their proxy to a RMR neighbor to represent them and their views at any meeting over a 180 day period since they are routinely unable to attend meetings of the association.

Additionally, if you are unable to attend a meeting of the POA membership, the General Proxy Form will be used to establish a quorum of a minimum of 35 regular members (RMRPOA Bylaws, Article 3, Section 3.06). If you are able to attend the meeting, this proxy vote will be revoked and you will be entitled to vote in person on any matter placed before the membership. However, no vote shall be invalidated by revocation of the proxy after a vote by the proxy has been cast.

The Annual POA Meeting Proxy Form must be completed, signed by the property owner, and returned by mail or in person to the River Mountain Ranch POA Board Secretary prior to the beginning of the scheduled RMRPOA Annual Meeting. This specific Proxy Form is only valid for the RMRPOA Annual Meeting on 21 January 2012 and is not valid for any other purposes (RMRPOA Bylaws, Article 3, Section 3.08). A proxy form will be posted for the POA Summer Meeting once the Board has set the date, time, & place for the meeting.

Board Actions: Ratification of Cattle Grazing Arrangement with RMRCC

During the regularly scheduled meeting on 13 May 2010, the RMR Board took action to ratify the grazing lease agreement between RMRPOA and the River Mountain Ranch Cattle Company (RMRCC) plus the associated terms & conditons of the agreement. This is the Process to be Used by Those Owners That Have Received a Notice from Hays County that Their Ag-Valuation Has Been Removed and/or You Need a New Grazing Lease for Submittal to Hays County (2012 UPDATE)

The Hays County Appraisal District will typically require a property owner that has been granted an Ag-Valuation to resubmit the required paperwork to obtain a renewal of their Ag-Valuation every 5 years. This process allows the County to evaluate if any changes have been made to the property's usage.

RMRCC recently found out from the HCAD, that yes, the "Additional Lessee Information" form was included in everyone's packet from the county, but, only RMRCC, as Lessee needs to fill out the form and not each individual property owner.   The "Grazing Lease Agreement" (see below) is all that is needed from River Mountain Ranch Cattle Co.  

This is the RMRCC Grazing Lease.  Please click the link below and download either the Word or PDF version. Please fill in the highlighted areas, NOTE:  Complete description of the property is needed under Roman Numeral "I" HCAD ID # - Location - Section - Lot - Acres Leased - Homestead (HS), and fax to RMRCC at 512-847-0097. The document will then be signed by the RMRCC Representative (Mike Hicks), make a copy for RMRCC records, and fax it back to the property owner (please provide your return fax number when you fax the documents to RMRCC). If an individual owner does not have access to a fax, then please call RMRCC to make arrangements to provide the property owner with the documents for them to turn-in to the County.

The grazing lease agreement is the document that you turn-in to Hays County along with the apllication for the Ag Valuation that they sent to you in the mail.
